Terms and Conditions for Enrollment and Financial Obligations at Texas Success Academy, LLC ("TSA")

Acceptance of Terms

  1. Acknowledgment: By submitting this enrollment request, you acknowledge that you have read, understood, and agree to abide by the terms and conditions and financial policies of Texas Success Academy, LLC.
  2. Authority to Contract: You represent and warrant that you are of legal age and authorized to enter into this tuition contract, both for yourself and for any students you are enrolling.

Financial Obligations

  1. Non-Refundable Registration: Registration fees, where applicable, are non-refundable under any circumstances.
  2. Tuition Contract: Upon enrollment, you are entering into a legally binding contract for the payment of tuition and any associated fees. Failure to adhere to this contract may result in legal action and additional charges.
  3. Discount Reversal: If you received a tuition discount and subsequently withdraw from TSA, you agree to be responsible for the full tuition amount, devoid of any discounts.
  4. Cancellation of a Service Plan­. You may cancel your academic service plan by contacting finance at any time and for any reason. All the fees are non-refundable, however, you can continue taking your classes until the end of the billing cycle, then access will end. 

Contractual Consequences

         7. Breach of Terms: Non-compliance with any of the terms outlined in this agreement will be considered a breach of contract and may result in                        immediate withdrawal, suspension, expulsion or revoke of credentials from the school. TSA also reserves the right to take legal action and to                        recover any additional costs incurred as a result.

By submitting this enrollment request, you confirm your acceptance of these Terms and Conditions, thereby entering into a legally binding agreement with Texas Success Academy, LLC.

Non-Discrimination Statement 

Texas Success Academy and its affiliates do not discriminate on the basis of race, religion, color, national origin, sex, or disability in providing education or providing access to benefits of education services, tutoring, and programs, in accordance with Title VI of the Civil Rights Act of 1964, as amended; Title IX of the Educational Amendments of 1972; Section 504 of the Rehabilitation Act of 1973, as amended; and Title II of the Americans with Disabilities Act of 1990.

  1. where students enrolling must display a clear understanding of the English language.
  2. admits students regard to race, sex, age, disability, religion, sexual orientation or color.
  3. retains the right to refuse enrollment or re-enrollment from any student whom the Superintendent believes will not benefit from or work well within the TSA  educational system.
  4. No reduction or refund of fees is given in the case of student non-performance, lack of course completion or being withdrawn from TSA
  5. A student may withdraw from TSA School upon written notification to the registrar. Incomplete coursework is not considered a cancellation of enrollment.

PROCTOR REGISTRATION REQUIRE FOR ALL STUDENTS REGARDLESS OF AGE

What is a Proctor? A Proctor is a person who monitors students during an examination.

To ensure academic integrity, upon registration with Texas Success Academy, a proctor is required for each quiz or test. However, the TSA staff recommends that each student pursue one or more qualified individuals to serve as a confirmed proctor (or monitor) during each test session. Proctors are not required for other activities including "Study" sessions. Students under the age of 18 must register at least one parent or guardian as a proctor. A proctor must then be declared prior to initiating any test session.

Proctors must be over the age of 18 years old.

You cannot be your own proctor.

Students who are taking classes while at their home school, will need to have a designated proctor on campus. Proctors can be a teacher, counselor or a person assigned by the Principal.

Having a proctor will ensure educational integrity while the student is taking the exam. Please thank your proctor for their support.

Dual Credit students will need a photo ID and Phone to record their exams. Your support team at the college will explain how they proctor exams.

We are being more descriptive in this policy to ensure everyone understands the importance of academic integrity. For more information related to Proctored exams, please read the Parent/Student Handbook.

Enrollment Policy at Texas Success Academy ("TSA")

Student Responsibilities

  1. Lesson Management: Students are responsible for keeping track of all completed lessons, materials, and assignments. Failure to submit finished work in a timely manner may result in additional fees.
  2. Submission Methods: Completed work should be submitted via the online platform, email, or postal mail to Texas Success Academy's official address.
  3. Updating Personal Information: Students are required to inform the Registrar of any changes in personal information, such as address or name, via email. This should be done as promptly as possible and ideally prior to graduation.
  4. Communications: It is responsibility to save Texas Success Academy's email to ensure you receive all correspondence. When you enroll, your form states, please check junk or spam folder. We will not be held liable for any missed emails. 



Policy on Completed Classes

Tuition Responsibility

  1. No Tuition Adjustment for Early Completion: Students who complete their courses prior to the end of the semester are still responsible for full tuition payments, as they have earned the course credits.
  2. Credit Earned: Completion of courses means credits have been earned, regardless of the time taken to complete the course.
  3. Obligation: Finishing courses early does not negate the financial obligation to pay the full tuition as agreed upon at the time of enrollment.

By enrolling in courses at Texas Success Academy, you agree to adhere to these policies and accept any associated fees or charges. Failure to comply may result in academic and financial penalties.

Course Completion Timeframe

K-12 Students

Standard Completion Policy: K-12 students must complete their semester courses within five (5) months and full-year courses within ten (10) months from the date of enrollment. This schedule is designed to ensure that students remain on track with their educational goals and are able to fully benefit from the curriculum provided.

Extension Policy:

  1. One-Month Grace Extension: K-12 students who are unable to complete their courses within the standard completion period may be granted a one-time, one-month grace extension at no additional cost. This extension is to provide students with additional time to complete their courses without undue pressure.
  2. Three-Month Extended Enrollment: For K-12 students requiring additional time beyond the one-month grace period, a three-month extended enrollment option is available for a fee. This option is designed to give students who need more time due to extenuating circumstances the ability to complete their coursework without disruption to their educational progression.

Active Engagement: To remain on track for timely course completion, K-12 students are recommended to engage with their coursework actively, which involves participating in their studies at least five times a week.

Requesting an Extension

To activate either extension policy, students must:

  • Submit a written request to the Finance Department at least two weeks prior to the expiration of their Standard Completion Timeframe.
  • Provide a rationale for the requested extension.
  • If requesting the Three-Month Extended Enrollment, remit the applicable fee as per the fee schedule provided at the time of the request.

Conditions

  • The One-Month Grace Extension is automatically available to all students and can be utilized once during the student's enrollment.
  • The Three-Month Extended Enrollment option is subject to approval by Texas Success Academy and contingent upon the payment of the extension fee.
  • Extensions beyond the Three-Month Extended Enrollment period are not standard policy and will be considered on a case-by-case basis, requiring a detailed submission and review.

Commitment to Completion

Texas Success Academy is dedicated to your educational success and progress. We encourage all students to utilize the resources provided, maintain consistent communication with instructors, and adhere to a disciplined study schedule to ensure timely completion of courses.

By enrolling with Texas Success Academy, you agree to the terms outlined herein, which are designed to promote a commitment to learning and timely completion of your studies.

Please note that the terms of the extension and the associated fees are subject to change and students will be notified accordingly. All students requesting an extension must do so in writing prior to the expiration of their original course term. Extensions are not automatic and require approval from Texas Success Academy administration.


Course Completion Timeframe

Standard Completion Policy

Adult students enrolled at Texas Success Academy are expected to complete their courses within one (1) year from the date of their enrollment ("Standard Completion Timeframe"). To achieve this goal, students should be actively engaged in their studies, dedicating time to their coursework at least three times a week.

Extension Policy

We understand that sometimes life presents unforeseen challenges that may impact your ability to meet the Standard Completion Timeframe. In such cases, Texas Success Academy offers the following extension options to support your learning journey:

  1. One-Month Grace Extension: If a student is unable to complete their coursework within the Standard Completion Timeframe, a one-time grace extension of one (1) month will be granted at no additional cost. This extension is provided to help students finalize and submit any outstanding coursework.
  2. Three-Month Extended Enrollment: Should a student require additional time beyond the one-month grace period, a further extension of three (3) months is available for a fee. This extended enrollment period allows students to continue accessing the course material and receive academic support to complete their studies.

Requesting an Extension

To activate either extension policy, students must:

Tuition and Fees Agreement for Texas Success Academy

By enrolling in Texas Success Academy ("TSA" or "the School"), you ("the Student", "the Parent paying for the student," or "you") agree to the following terms and conditions concerning tuition, fees, and payments, which constitute a legally binding agreement between you and Texas Success Academy. These terms are in accordance with all applicable laws and regulations. Failure to abide by these terms may result in legal consequences.

Acceptance of Terms

  1. Agreement to Terms: By accessing TSA's educational systems, materials, and courses, you consent to these terms and conditions. If you do not agree with any of these terms, you are prohibited from using or accessing TSA's services.
  2. Copyright and Trademark: All educational content provided by TSA is protected by applicable copyright and trademark law.

Tuition and Refunds

  1. Non-Refundable Policy: TSA offers knowledge-based courses. Upon logging into your student account and accessing any educational material, you acknowledge that tuition is non-refundable under any circumstance. Knowledge gained cannot be returned or revoked. This policy is unequivocal and applies even if you have logged in only once. This policy is FIRM.
  2. Chargebacks: Initiating a chargeback for the fees paid to TSA without prior consultation and agreement with TSA will be considered a breach of this agreement. TSA reserves the right to dispute any chargeback claims and to provide relevant documentation to the payment processor to validate the charge. You will be charged the chargeback fee of $15.00 for each dispute. 

Payment Options

  1. Payment in Full: Tuition may be paid in a single, one-time payment.
  2. Payment Plans: Tuition can alternatively be paid through a pre-agreed payment plan. Paid every month on the day selected.
  3. Automatic Payments: If you opt for a payment plan, the tuition payments will be automatically deducted from your account every 30 days from your enrollment date. Automatic payments can be canceled at any time; however, you remain responsible for making any remaining tuition payments.
  4. Online Payments: Payments made online will incur a transaction fee of 2.9% + $0.30 per transaction.

Default on Payment

  1. Consequences of Non-Payment: Failure to make a payment as scheduled will be considered a breach of this agreement and may result in immediate termination of access to TSA's services, legal action, and/or additional fees.

Amendments

  1. Updates to Terms: TSA reserves the right to modify these terms and conditions at any time. Any changes will be updated on the School’s website and, where appropriate, notified to you by email.

By continuing to use TSA’s services, you confirm your acceptance of these terms and conditions and any subsequent changes made.

Policy on Student Records Requests

Full Payment Required for Release of Records: At Texas Success Academy, our policy mandates that all student records, including transcripts, grade cards, and transfer records, will only be released upon full settlement of any outstanding tuition and fees.

  1. No Release Under Unpaid Tuition: No records will be issued to any student, parent, guardian, or third-party institution until the student’s account balance is cleared in full. This includes any pending tuition payments, late fees, or other associated charges.
  2. No Release Under Investigation: We will not release any records during an active investigation or any kind.  
  3. Application of Policy: This policy applies to all students, regardless of their enrollment status or the duration of their attendance at Texas Success Academy. It is our standard practice to withhold educational records until financial obligations are fulfilled.
  4. Notification: Students and families are reminded of this policy upon enrollment and again if any request for records is made while there is an outstanding balance on their account.
  5. Clearance of Account: Once the student’s account is cleared of any outstanding balances, requests for records will be processed in accordance with our usual protocols for records release.
  6. Contact Information for Billing Queries: For any questions regarding your account or to make a payment, please contact our finance department at [Contact Email/Phone Number].

By enrolling at Texas Success Academy, students and their families acknowledge and agree to this policy as a condition of their access to our educational services and records.

Policy on Delinquent Accounts

Account Status and Access to Services

  1. Access Restriction: Students with delinquent accounts will not have access to classes, coursework, or any educational resources until the account is brought current.
  2. Record Release: Official records, including transcripts, diplomas, and letters of completion, will not be released to students or forwarded to other educational institutions unless the account balance is paid in full.
  3. Enrollment Verification: Texas Success Academy will not provide any form of enrollment verification if tuition fees are due and the student account has been suspended or withdrawn due to nonpayment.

Communication and Notices

  1. Email Notifications: Students with delinquent accounts will receive two email notifications: an initial reminder and a final notice. These emails serve as official communication regarding the account status.
  2. Collections: If no payment is received or no communication is established by the student or parent/guardian within a specified period after the final notice, the delinquent account will be forwarded to a collections agency.

Additional Costs

  1. Legal and Collection Fees: The student will be responsible for any and all fees associated with collections, including but not limited to attorney’s fees and collections agency fees.

Policy on Dropping a Course at Texas Success Academy ("TSA")

Academic Considerations

  1. 5-Day Grace Period: Students may drop a course(s) without academic penalty within 5 days of enrollment, provided that the course has not been accessed or started. In such cases, the course will not appear on the student's Official Transcript.
  2. Withdrawal Mark: If the course is accessed and started, students may still drop the course, but a mark of "Withdrawal" or "W" will appear on the student's Official Transcript.
  3. Failing Grade: If the course is not dropped within the allowable period and the student fails, a failing grade will be assigned and displayed on the student's Official Transcript.

Financial Considerations

  1. No Refunds: No refunds will be issued for courses dropped more than five (5) days after the date of enrollment.
  2. Late Fee: A $30 late fee will be applied for each late payment.
  3. Invoice Responsibility: You are responsible for making sure your invoice is paid on time. Payments sent via mail must arrive at TSA's office by the due date, or they will be considered late.
  4. Administrative Withdrawal: If you are two months late on payments and have not made prior arrangements, you will be administratively withdrawn from TSA for nonpayment. Your account will then be transferred to our third-party collections agency.
  5. Collections Fee: The collections agency will charge a fee of 40% based on the total tuition and fees owed.
  6. Ongoing Responsibility: Even after administrative withdrawal or transfer to a collections agency, you remain responsible for all tuition and fees.


By enrolling at Texas Success Academy, you agree to abide by this policy and understand the academic and financial implications of dropping a course.

Enrollment and Payment Verification Policy at Texas Success Academy ("TSA")

Accuracy in Enrollment and Payment Selection

  1. Payment Review: Please exercise caution when enrolling in courses and selecting your payment options. The payment amount will be displayed for your review before you enter your credit card information. You have the opportunity to review this two to three times prior to confirming your payment.
  2. Non-Refundable Full Payment: If you choose to pay your tuition in full, please be aware that this payment is non-refundable. Once a full payment is made, the option to switch to a payment plan will no longer be available.

By enrolling at Texas Success Academy, you acknowledge that you have reviewed your enrollment choices and payment amount, and you agree to abide by TSA's financial policies and terms.


Dispute Resolution Policy at Texas Success Academy ("TSA")

Financial Disputes

  1. Over-Payments and Extra Payments: If you notice that an over-payment has been made or an extra payment has been deducted, please contact our accounting department by emailing Finance at finance@TexasSuccessAcademy.com. We will promptly resolve the issue and return the extra payment.
  2. Bank Disputes and Fees: If you choose to initiate a formal dispute with your bank regarding a payment to TSA, a service fee of $25.00 may be charged to your account for the administrative costs of resolving the dispute.

Legal Disputes and Arbitration

  1. Arbitration Clause: Any disputes or claims related in any way to Texas Success Academy, including but not limited to policies, procedures, classes, advisement, or educational services provided by TSA or any third-party associated with TSA, will be resolved through binding and confidential arbitration, rather than in court.

By continuing your enrollment and participation at Texas Success Academy, you agree to comply with the terms of this Dispute Resolution Policy.

Withdrawal and Refund Policy at Texas Success Academy ("TSA")

General Guidelines for Withdrawal

  1. Notification Requirements: To officially withdraw from TSA, you must provide written notification to the Finance Department, before receiving any academic records. Failure to complete coursework does not qualify as a cancellation of enrollment, and all associated fees remain due.
  2. 5-Day Cancellation Window: You have a period of 5 days from the time you receive your username and password to request a cancellation of your enrollment, provided that you have not started any classes. Beyond this 5-day window, no refunds will be issued.

Financial Obligations

  1. Full Tuition Responsibility: Upon enrollment, you are financially obligated to pay the full tuition for the courses in which you enroll. TSA cannot negate or cancel any unpaid financial obligations if you or your enrolled student decides to withdraw, or is forced to withdraw for any reason.

Administrative Withdrawal

  1. Behavioral Expectations: We require all interactions with TSA staff, teachers, and administrators to be conducted respectfully. Failure to maintain this standard may result in administrative withdrawal from TSA.
  2. Best Interest Decisions: TSA reserves the right to administratively withdraw a student if we determine that the student's educational needs would be better met at another institution. Should this occur, the student will be notified and officially withdrawn.

By enrolling at Texas Success Academy, you acknowledge that you understand and agree to abide by this Withdrawal and Refund Policy.

Returned Check and Declined Credit Card Policy at Texas Success Academy ("TSA")

  1. Accepted Payment Methods: TSA accepts money orders, cashier’s checks, credit, and debit cards for tuition payments.
  2. Fees for Returned Checks or Declined Cards: A $30 fee will be charged for any returned checks or declined credit cards. This will also mean that your tuition payment is considered late.
  3. Responsibility for Late Fees: Both students and parents are responsible for any late fees that are assessed.

Cancellation Policy at Texas Success Academy ("TSA")

  1. Cancellation Rights: You may cancel your enrollment at any time, but please note that tuition fees are non-refundable.
  2. Billing Period: Tuition is billed on a monthly or annual basis and is non-refundable.
  3. No Partial Refunds: There will be no refunds or credits for partial months of service, nor refunds for months unused with an open account.
  4. Equal Treatment: In order to ensure fairness to all students, no exceptions to this policy will be made.

Collections Policy at Texas Success Academy ("TSA")

  1. Use of Collections Agencies: Texas Success Academy, LLC utilizes attorneys and/or external collections agencies to recover all past-due balances.
  2. Collections Fee: A fee amounting to 50% of the total balance owed will be charged by the collection agency, and you will be responsible for this fee.
  3. Non-Payment and Collections: After two months of non-payment, your account will be placed on a list for collection. Additional fees required for collections will be added to your existing balance.
  4. Reinstated Fees: If you received any tuition discounts or had fees waived, these will be reinstated to your account, as you will no longer be considered a student in good standing.
  5. Re-Enrollment after Collections: You will have one year from the time your account goes to collections to clear your balance if you wish to return and complete your classes. Failure to do so will require a new application and full tuition payment.

Texas Success Academy ("TSA") Standard of Conduct Policy

General Guidelines

At Texas Success Academy (TSA), we uphold a standard of excellence not only in education but also in conduct. All students and their parents or guardians are expected to adhere strictly to the standards of conduct as detailed in the Student Handbook. Violation of these standards, including acts that compromise the integrity or reputation of TSA, will result in immediate and decisive action. This may include expulsion, administrative withdrawal, or termination of enrollment without notice or refund. Enrollment at TSA extends until the issuance of a diploma and transcripts arrive at your door or placed in hand. Severe violations, such as fraudulent activities or defamation, will lead to immediate expulsion and possible revocation of credentials.

Note: Termination for any conduct violation does not entitle the offender to a refund, in whole or in part.

Core Principles of Conduct:
1. Respect: Dignity and respect for all are non-negotiable.
2. Integrity: We demand honesty and responsibility in all interactions.
3. Non-Violence: Any form of threats, intimidation, or violence is unacceptable.
4. Authenticity: Using false identities to tarnish TSA's reputation is strictly forbidden.
5. Communication: All dialogue should be respectful, constructive, and clear.
6. Legal Compliance: Adherence to all laws and regulations is mandatory.

Student Expectations:
Respect all members of the TSA community, including staff and fellow students.
1.Follow academic integrity guidelines as outlined in the handbook.
2.Accurately represent your relationship with TSA.
3.Keep abreast of and comply with all TSA policies and communications.
4.Conduct yourself respectfully in all forums, especially when representing TSA or addressing school personnel.
5.Refrain from spreading misinformation or engaging in slanderous activities against TSA.

Parent/Guardian Expectations:
1.Maintain respectful and professional communication within the school community.
2.Support TSA's educational objectives and policies enthusiastically.
3.Collaborate with TSA staff on any academic or behavioral issues.
4.Avoid any form of harassment or intimidation toward TSA staff or community.
5.Actively contribute to school functions in a positive and respectful manner.

Addressing Concerns:
Pause and take a moment to collect your thoughts.
Understand that we are here to support and assist you.
Initially, contact Ms. Christi Pierce for guidance and resolution.
If issues persist, the Superintendent's Office will intervene for further assistance.

Consequences of Misconduct:
Verbal or Written Warning: Issued for initial or minor infractions.
Communication Restriction: Applied in cases of abusive or harassing behavior.
Temporary Suspension: Enacted during investigations of serious allegations.
Academic Withdrawal: Possible for serious violations, lasting either a semester or a full year.
Administrative Withdrawal: Permanent expulsion from TSA for egregious breaches of conduct.
Revocation of Credentials: If a student, after being awarded a diploma, is found to have violated significant conduct policies or engaged in activities that severely damage the reputation or operational integrity of the school, the school may choose to withdraw the diploma.
Legal Action: Pursued for illegal activities, including threats, violence, or defamation.

Enrollment at Texas Success Academy signifies your agreement and commitment to uphold these standards of conduct. We reserve the right to take any necessary actions to ensure a safe, respectful, and productive learning environment for all.

Recall of Graduation Due to Poor Behavior or Character Policy

1. Introduction

Texas Success Academy (TSA) is committed to fostering an environment of academic excellence, personal growth, and integrity. Our mission extends beyond academic achievement to include the development of character and ethical behavior in our students. As such, TSA reserves the right to recall graduation credentials if a student demonstrates behavior significantly at odds with the values and standards expected of our graduates.

2. Grounds for Recall

Graduation credentials may be recalled under the following circumstances:

  • Evidence of dishonesty or fraud in the completion of academic work or public statements.
  • Serious misconduct or behavior that undermines the integrity of the TSA community or its values, including but not limited to bullying, harassment, or other forms of discrimination.
  • Criminal behavior that brings the Academy into disrepute.

3. Procedure for Recall

  • Investigation: Upon receiving credible information regarding misconduct, TSA will initiate a confidential investigation to ascertain the details of the case.
  • Notification: If the investigation substantiates the concerns, the student will be notified in writing of the intention to recall their graduation credentials, including a detailed explanation of the reasons and evidence supporting this decision.
  • Appeal: The student will have the opportunity to appeal the decision by submitting a written response within 30 days of notification, presenting any additional information or context for consideration.

4. Pathway to Redemption

TSA believes in the capacity of individuals to grow and change. Students whose graduation credentials have been recalled may apply for reinstatement under the following conditions:

  • Correct the Misconduct: Correct the issue that led to the violation of the Code of Conduct. Submit the corrections to be reviewed.
  • Reflection Paper: Submit a reflective essay discussing the behavior that led to the recall, the lessons learned, and how they have worked to improve their character and behavior.
  • Community Service: Complete a designated number of hours of community service at an organization approved by TSA, demonstrating a commitment to positive societal contributions.
  • Character References: Provide letters from at least two individuals (not related to the student) attesting to the student’s character development and positive behavior since the recall.
  • Waiting Period: Observe a mandatory waiting period of at least one year from the date of recall before applying for reinstatement of credentials.

5. Reinstatement of Credentials

Applications for reinstatement will be reviewed by a committee designated by TSA, considering the evidence of growth and positive change demonstrated by the student. The decision of the committee will be final. The fee for reinstatement is $250.00.

6. Implementation and Communication

This policy will be in the Terms and Conditions. TSA is dedicated to ensuring that all students are aware of the standards of behavior and integrity required, as well as the consequences of failing to uphold these standards.

Standard of Conduct Policy

Texas Success Academy students will agree to conform to the standards of conduct as posted in the Student Handbook. Texas Success Academy reserves the right to expel, administratively withdraw or terminate any student based on the action of the student or parent(s) without notice or refund in accordance with the policy posted on the site and/or handbook. 

Termination of admission for any reason does not allow for any refund, even prorated.

Release of Information Policy

Student information will only be disclosed to individuals explicitly authorized by the student. Authorization must be either indicated on the registration form or provided through a signed third-party consent form.


Notice of Updates to Terms and Conditions

Ongoing Updates: Texas Success Academy reserves the right to amend and update these Terms and Conditions at any time to reflect changes in our services, the needs of our students, or for other operational, legal, or regulatory reasons.

Responsibility to Review: It is the responsibility of each student and their family to regularly review these Terms and Conditions to stay informed of any changes. Up-to-date Terms and Conditions will always be accessible on our website.

Acknowledgment of Changes: Continued enrollment and use of Texas Success Academy's services after any such changes take effect will constitute acceptance of and agreement to any new terms. As such, we encourage you to check the Terms and Conditions periodically to ensure you are familiar with the most current version.

Notification of Significant Changes: While we will make efforts to notify students of any significant changes to the Terms and Conditions, it is ultimately the student's responsibility to review any updates.

All terms and conditions set forth by Texas Success Academy and will be enforced to the fullest extent permitted by law. However, in the event that any part of our terms and conditions is found to be in violation of applicable laws, that portion shall be considered null and void, while the remaining provisions will continue in full force and effect.
